Subminimum Wage

The subminimum wage was created for employers to pay certain employees below their state’s mandated minimum wage. Moreover, the Subminimum wage, a method commonly known, is permitted under section 14(c) of the Fair Labor Standards Act (FLSA). This provision was mandated in 1938 to account for “substandard workers” who were “not up to normal production.” According to the Department of Labor’s website, Hour Division pays wages less than the federal minimum wage to workers called the subminimum wage. Subminimum wages are for “individual workers such as students whose earning or productive capacity is impaired by a physical or mental disability, including those related to age or injury, for the work to be performed.

Over the years, subminimum wage has become a mainstay of employers who wish to exploit the severely disabled without delivering a pathway toward meaningful work and the minimum wage. This method usually occurs at retail businesses or in vocational rehabilitation centers and “sheltered workshops”, where disabled workers are paid depending on productivity at a small fraction of a non-disabled worker’s rate. According to government audits, the workshops suit as segregated work environments from which as few as 5% of workers transition into employment in the community. In such exploitative conditions, disabled workers are given neither the dignity of receiving a fair wage nor the training or resources to participate in outside jobs

Now, updates on subminimum wage in some states that most governments in their states are working to change this system, not the federal government and President Joe Biden.

 Updates on subminimum wage in some states are making progress and will soon unite the above list, with states such as Virginia, Connecticut, New York, and New Hampshire far along this journey.

Meanwhile, the updates on subminimum wage in some states in Arizona, Massachusetts, Minnesota, Missouri, California, Indiana, Mississippi, and Nebraska are also in the early stages of eliminating certain sections of the law on subminimum wage.
