Oregon Suspect Released Day He Arrived At Nevada Prison

 A man at the center of an intense police search in Oregon after a violent kidnapping last week was released from custody in October 2021 by a Nevada prison. Authorities said Monday, that on the same day, he was moved to the state’s custody to serve a kidnapping sentence. Grants Pass Police Chief Warren Hensman said in a phone interview that he finds it “extremely troubling” that the offender is wanted in an attempted murder instead of still being behind bars for the Nevada crimes.

Benjamin Obadiah Foster, 36, faced decades in prison in Nevada after he was charged in 2019 with five felonies, including battery and assault. Foster tried to kill the victim in Grants Pass while “intentionally torturing” her and hiding her “in a position where she was not likely to be found,” Josephine County District Attorney Joshua Eastman reported in a court document.

A deal with Clark County prosecutors allowed Foster to instead plead guilty to a felony and misdemeanor battery, and a judge sentenced him in September 2021 to serve between one and 2 1/2 years in state prison. But after Foster’s punishment the 729 days he had spent in jail awaiting trial were factored into his punishment, Foster was left to serve less than 200 additional days in state custody.

Foster Was Arrested By SWAT

Foster’s girlfriend at the time had suffered seven broken ribs, two black eyes, and injuries from being bound at the wrists and ankles with zip ties and duct tape during her two-week captivity. The woman also informed police she was forced to eat lye and choked to the point of blackout. Fortunately, She escaped during a trip with Foster to a grocery store and a gas station, after Foster had let the woman out of his sight. According to the police report, the woman rushed by foot to a nearby apartment complex and found a resident that rushed her to a hospital. Foster was captured by SWAT officers later that day.

At the time, Foster was out of detention at the time due to a suspended jail sentence for carrying a concealed firearm without a permit according to the court. In 2018, Foster also faced trial in another case involving domestic violence. But Foster’s plea bargain with the prosecutors in 2021 resolved the domestic violence case, a copy of the agreement shows, and he was “sentenced to credit for time served.”

Police in Grants Pass, a town of some 40,000 in southwest Oregon, provided current photos in a news release of Foster driving with a Nissan Sentra car and believed to be armed.  Moreover, on Tuesday, police went to a home in a residential neighborhood of Grants Pass to investigate. Upon arriving, the officers discovered a woman who had been tied and beaten unconscious. She was brought to a hospital in critical condition, police said. “This is a very serious occurrence, a vicious assault of one of our residents that we take seriously,” the police chief added. “And we will not sleep until we capture this criminal.”

Hensman said he doesn’t have time now to investigate how authorities in Nevada handled Foster’s crimes there.
