$5,000 may be the highest claim that a Class Member from the company Ibex after it settled a multimillion-dollar data breach lawsuit. While the company did not admit wrongdoing, Ibex agreed to pay $2.4 million to resolve the claims. A valid claim form must be submitted by all class members by March 20, 2023.
Ibex’s failure to implement and maintain reasonable security measures that adequately protected them is the number reason for this action and resulted in the plaintiff’s claim being realized. The consumers may have compromised their personally identifying information during the data security incident between July 27, 2020, and Aug. 17, 2020. Class members are not only going to receive cash from the potential claim, but they are also eligible for five years of free credit monitoring and inclusion of up to $1 million in identity theft insurance.
The deadline for exclusion and objection is Feb. 17, 2023, while the final approval hearing for the settlement is scheduled for March 10. Class Members must submit a valid claim form by March 20, 2023, to receive settlement benefits. An online claim must be submitted to the Settlement Administrator through e-mail or traditional mail.
$5,000 Worth of Reimbursements for Settlement Benefits
According to the settlement website, the Net Settlement Fund will provide eligible Settlement Class Members with a few options for payments and benefits.
Reimbursements for Lost Time and Out-Of-Pocket Expenses
Lost Time
Due to the Data Security Incident a claim for reimbursement may also include a claim for up to 5 hours spent. The compensation for this is $25 per hour and requires a brief description of the action taken in response to the Data Security Incident and the time associated with those actions.
Out-of-Pocket Expenses
Due to the Data Security Incident a claim for reimbursement may include but is not limited to expenses incurred.
- purchasing credit monitoring or identity theft insurance
- requesting a credit report
- credit freeze
- canceling a payment card and/or obtaining a replacement payment card
- closing a bank account and/or opening a new bank account
- Postage, long-distance phone charges, express mail, and other incidental expenses, if you provide documentation of the charges and an explanation satisfactory to the Settlement Administrator of their relationship to the Data Security Incident
- Unrefunded overdraft and/or overdraft protection fees
- Unrefunded late and/or missed payment fees and/or charges
- Damage and costs associated with any stolen benefits or tax returns
Cash Payments for Identity Theft or Data Misuse
A cash payment of $100 is to be given to eligible Class Members who experienced actual or attempted identity theft or data misuse. You must submit a valid Claim Form that includes documentation demonstrating that the Settlement Class Member: experienced actual or attempted identity theft, experienced another verifiable misuse, including receiving fraud alerts or alerts of information is on the dark web.
$5,000 is the maximum claim for Lost Time, Out-of-Pocket Losses, and Cash Payment for Identity Theft or Data Misuse is $5,000.
